1 Introduction & Acceptance of Terms

These Terms & Conditions ("Terms", "Agreement") constitute a legally binding agreement between you ("Player", "User", "you") and 39daph ("the Company", "39daph", "we", "us"), the operator of the online gaming platform accessible at 39daph.cam (the "Platform").

By accessing the 39daph Platform, creating a user account, making a deposit, claiming a bonus, or placing any wager, you unconditionally accept and agree to be bound by these Terms, the Privacy Policy, the Responsible Gaming Policy, and any game-specific rules or promotional terms published on the Platform from time to time.

If you do not agree to any part of these Terms, you must immediately discontinue your use of the 39daph Platform and close your account. Continued use of the Platform after any amendment to these Terms constitutes your acceptance of the revised Terms.

2 Eligibility & Account Registration

2.1 Age Requirement

Use of the 39daph Platform is strictly limited to natural persons who are at least 21 years of age at the time of registration. This age requirement is mandated by Philippine law and the regulations of the Philippine Amusement and Gaming Corporation (PAGCOR). By registering an account on 39daph, you represent and warrant that you satisfy this age requirement. The Company reserves the right to request government-issued proof of age at any time and to suspend accounts pending age verification.

2.2 Geographic Eligibility

The 39daph Platform is intended for use by players located in jurisdictions where accessing online gaming services is lawful. It is your sole responsibility to determine whether accessing and using the Platform complies with the laws applicable in your jurisdiction. The Company makes no representation that the Platform is appropriate or available for use in any particular location outside the Philippines.

2.3 One Account Policy

Each individual player may maintain only one (1) active account on the 39daph Platform. Duplicate accounts, whether created using different names, email addresses, mobile numbers, or payment methods, are strictly prohibited. The Company employs device fingerprinting and identity verification technology to detect duplicate accounts. All duplicate accounts will be closed, balances forfeited, and the player may be permanently banned from the Platform.

2.4 Registration Information

You agree to provide accurate, current, and complete information during registration, including your legal full name, date of birth, valid Philippine mobile number or email address, and a password. You further agree to promptly update this information if it changes. The Company shall not be liable for any loss resulting from your failure to maintain accurate account information.

2.5 Know Your Customer (KYC) Verification

To comply with applicable anti-money laundering regulations, 39daph requires all members to complete identity verification before withdrawals are enabled. Acceptable Philippine government-issued identification documents include: SSS ID, PhilHealth ID, Passport, Driver's License, UMID, and Voter's ID. Verification requests must be responded to within fourteen (14) days or the account may be restricted.

3 Account Security

You are solely responsible for maintaining the confidentiality of your 39daph login credentials, including your password and any OTP (one-time password) codes sent to your registered mobile number. You must not share your credentials with any third party.

You agree to notify 39daph immediately at [email protected] if you become aware of any unauthorized access to your account or any security breach affecting your login credentials. The Company shall not be held liable for any losses arising from your failure to safeguard your account credentials.

The Company reserves the right to lock any account that shows signs of suspicious activity pending investigation. In such cases, you will be notified via your registered contact details and asked to verify your identity through the standard KYC process.

4 Deposits & Payments

4.1 Supported Payment Methods

39daph currently supports the following deposit methods for Philippine players: GCash, Maya (formerly PayMaya), GrabPay, QR Ph, BPI, BDO, Metrobank, and 7-Eleven CLiQQ. The available methods at any given time may vary and are subject to change without prior notice. The Company does not charge deposit fees, though your payment provider may apply their own charges.

4.2 Minimum Deposit

The minimum deposit amount on 39daph is ₱100 per transaction. Maximum deposit limits may apply depending on your account tier, selected payment method, and any limits imposed by your payment provider. Specific limits are displayed on the cashier page at the time of transaction.

4.3 Deposit Processing

GCash, Maya, and QR Ph deposits are processed instantly under normal network conditions. Bank transfer deposits may take up to two (2) banking days to reflect in your 39daph wallet. If a deposit has not reflected within the stated processing time, contact 39daph Support with your transaction reference number.

4.4 Deposit Source

You may only deposit funds from payment methods registered in your own name. Deposits from third-party accounts, anonymous payment sources, or cryptocurrency wallets are not accepted. Any deposit identified as originating from a third-party source will be reversed and the account may be suspended pending investigation.

5 Withdrawals

5.1 Withdrawal Eligibility

Withdrawals are available to fully verified (KYC-completed) 39daph accounts only. The minimum withdrawal amount is ₱100. Withdrawals must be directed to the same GCash number, Maya account, or bank account that was verified during the KYC process. The Company does not process withdrawals to third-party accounts under any circumstances.

5.2 Withdrawal Processing Times

E-wallet withdrawals (GCash, Maya) for verified accounts are typically processed within minutes to a maximum of four (4) hours. Bank transfer withdrawals are processed within one (1) to three (3) banking days. Processing times may be extended during Philippine public holidays or periods of high transaction volume.

5.3 Wagering Requirements on Withdrawals

A deposit that has not been wagered at least once (1x turnover) is subject to a processing review before withdrawal. This requirement exists to comply with anti-money laundering obligations and does not apply to funds generated from actual gameplay. Bonus funds carry their own wagering requirements as described in Section 6 and the relevant promotion terms.

5.4 Withdrawal Fees

39daph does not charge withdrawal fees. However, your bank or e-wallet provider may impose their own transaction fees, which are beyond the Company's control and are the sole responsibility of the Player.

6 Bonuses & Promotions

6.1 General Bonus Terms

All bonuses, free spins, cashback offers, and other promotional credits offered by 39daph are subject to specific terms and conditions that are published on the relevant promotion page. These promotion-specific terms — including wagering requirements, eligible games, minimum deposit thresholds, maximum withdrawal from bonus funds, and expiry periods — are incorporated by reference into this Agreement.

6.2 Wagering Requirements

Unless otherwise stated on the specific promotion page, bonus funds must be wagered a minimum number of times before they may be converted to withdrawable cash. The wagering multiplier applicable to each promotion is clearly stated at the time of offer. Wagers placed on games excluded from bonus play do not count toward wagering requirements.

6.3 Maximum Bet with Active Bonus

While a wagering requirement is active on your 39daph account, the maximum bet per round or spin from bonus-associated funds is ₱500 unless the promotion specifies otherwise. Bets exceeding this limit during an active bonus period may result in the forfeiture of the bonus and any associated winnings.

6.4 Bonus Abuse

39daph employs automated and manual monitoring to detect bonus abuse, including but not limited to: claiming the same bonus using multiple accounts, employing low-risk wagering strategies designed to exploit bonus terms, or using any automated system to generate bonus turnover. The Company reserves the right to void bonuses and withhold associated winnings from any account determined to have engaged in bonus abuse.

7 Gaming Rules & Fair Play

All games available on the 39daph Platform are provided by licensed third-party game providers and use certified Random Number Generator (RNG) technology to ensure fair and unpredictable outcomes. The Company does not modify game outcomes or RTP figures from those published by the respective game provider.

In the event of a discrepancy between information displayed on the 39daph Platform and the game provider's records, the game provider's server records shall be considered final and binding for all settlement purposes.

For live dealer games, the house rules of the physical dealing studio apply in addition to these Terms. In the event of a technical failure during a live dealer game that prevents its completion, the round will be voided and stakes returned to players.

The Company reserves the right to declare bets void and return stakes in circumstances where: a game malfunction has occurred that materially affected the outcome; where an obvious pricing error was displayed; or where bets were placed after the outcome of a sporting event was already determined.

8 Prohibited Conduct

The following conduct is strictly prohibited on the 39daph Platform:

• Registering or using the Platform if you are under 21 years of age;
• Opening more than one (1) account for any individual player;
• Using automated software, bots, scripts, or any artificial means to interact with the Platform or place wagers;
• Colluding with other players in live dealer, poker, or any other multiplayer game format;
• Exploiting software errors, glitches, or vulnerabilities for financial gain;
• Using the Platform in any manner that facilitates money laundering, tax evasion, or other financial crimes;
• Providing false identification documents or misrepresenting your identity during KYC;
• Attempting to manipulate the outcome of any game through unlawful means;
• Conducting chargebacks on valid deposits processed by 39daph;
• Harassing, threatening, or abusing 39daph staff or other players through any communication channel.

9 Intellectual Property

All content on the 39daph Platform, including but not limited to the 39daph brand name, logo, website design, software, graphics, game interfaces, text, and marketing materials, is the exclusive intellectual property of the Company or its licensed content providers and is protected by applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform solely for your personal, non-commercial entertainment purposes. You may not copy, reproduce, republish, distribute, modify, or create derivative works from any Platform content without the prior written consent of the Company.

10 Responsible Gaming

39daph is committed to promoting responsible gaming among all Filipino players. The Company acknowledges that gambling can be harmful when not conducted in a controlled and informed manner. In accordance with PAGCOR guidelines, 39daph provides the following responsible gaming tools accessible from within your account settings:

• Deposit Limits: Set daily, weekly, or monthly deposit caps to control spending;
• Session Time Reminders: Receive notifications when you have been playing for a specified period;
• Cool-Off Period: Take a break from gambling for a defined period of 24 hours to 30 days;
• Self-Exclusion: Permanently exclude yourself from the 39daph Platform if gambling is causing harm.

Players who wish to self-exclude should contact 39daph Support at [email protected]. Self-exclusion requests will be processed within 24 hours. Once activated, self-exclusion cannot be reversed for the minimum exclusion period selected by the player.

11 Limitation of Liability

To the maximum extent permitted by applicable law, the Company, its directors, officers, employees, and agents shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the 39daph Platform, including but not limited to: loss of data, loss of revenue, loss of goodwill, gaming losses, or any other intangible losses.

The 39daph Platform is provided on an "as is" and "as available" basis. The Company makes no warranties, express or implied, regarding the availability, accuracy, reliability, or suitability of the Platform for any particular purpose. Interruptions to service caused by scheduled maintenance, third-party provider outages, force majeure events, Philippine telecommunications disruptions, or circumstances beyond the Company's reasonable control shall not constitute a breach of these Terms.

In no event shall the Company's aggregate liability to you for any claim arising from your use of the Platform exceed the total net deposits made by you to 39daph in the thirty (30) days preceding the event giving rise to the claim.

12 Account Suspension & Termination

The Company reserves the right to suspend or permanently close any 39daph account at its sole discretion, with or without prior notice, in the following circumstances:

• Breach of any provision of these Terms;
• Failure to complete KYC verification within the required timeframe;
• Reasonable suspicion of fraudulent activity, money laundering, or collusion;
• Chargebacks filed against legitimate 39daph transactions;
• Discovery that the account holder is under 21 years of age;
• Requests by regulatory authorities or law enforcement agencies;
• Extended account inactivity as defined in the Company's dormancy policy.

Upon account closure for legitimate reasons (i.e., voluntary closure not involving misconduct), any verified real-money balance will be returned to the player's verified payment method within ten (10) business days, less any applicable bonus amounts that had not satisfied their wagering requirements.

You may voluntarily close your 39daph account at any time by contacting Support at [email protected]. Please allow up to three (3) business days for voluntary account closure requests to be processed.

13 Governing Law & Dispute Resolution

These Terms & Conditions shall be governed by and construed in accordance with the laws of the Republic of the Philippines, without regard to its conflict of laws provisions.

In the event of any dispute arising out of or in connection with your use of the 39daph Platform or these Terms, you agree to first attempt to resolve the dispute informally by contacting 39daph Support at [email protected]. The Company will endeavour to respond to and resolve informal disputes within fourteen (14) business days.

If a dispute cannot be resolved informally within thirty (30) days of first contact, either party may submit the dispute to the exclusive jurisdiction of the competent courts of the Philippines.

14 Amendments to These Terms

The Company reserves the right to amend, modify, or update these Terms & Conditions at any time. Material changes will be communicated to registered players via the email address or mobile number on file at least seven (7) days before the changes take effect, except where changes are required to comply with legal obligations, in which case they may take effect immediately.

The current effective version of these Terms is always accessible at 39daph.cam/terms-conditions. Your continued use of the Platform following the effective date of any amendment constitutes your acceptance of the revised Terms. If you do not accept the revised Terms, you must close your account before the effective date of the changes.
